Human Rights Activist Called on Prosecutor General to Investigate Facts of Torture
Baku / 22.04.19 / Turan: Human rights activist Oktay Gyulaliyev on April 21 delivered an open letter to the Prosecutor General Zakir Garalov.
He points to an increase in cases of arrests on libelous accusations of socio-political activists, putting pressure on them, the use of torture and even murder.
In particular, the human rights activist points to torture of those arrested in connection with the Ganja events and the "Terter case," and opposition representatives.
"During the trial of the events in Ganja on July 10, 2018 in the Sabunchu District Court, it became clear once again that those arrested were subjected to sophisticated torture in the Ganja police and the Directorate General for Combating Organized Crime of the Ministry of Internal Affairs. All this happened in front of high-ranking employees of the Prosecutor General"s Office.
Most of the accused said that one of those who led the torture was the responsible officer of the Investigation Department for Grave Crimes of the Prosecutor General's Office Orkhan Babayev. However, despite the petitions of the accused and lawyers, Orkhan Babayev was not summoned to court, and no measures were taken against those who used torture, "Gyulaliyev writes.
At the same time, the arrested were charged not adequately to their actions. So despite the fact that they did not commit criminal actions, they were charged with crimes under 15-23 articles of the Criminal Code, and were not provided with lawyers.
Most of the persons whom the Prosecutor General"s Office calls an organized criminal group do not even know each other.
Gyulaliyev notes that the eight men killed, according to the security forces, when providing armed resistance, were in fact unarmed. The body of one of the victims, Aga Sarkhani, has not been given out to the family for 9 months.
The human rights activist also points to the cruel torture of the military arrested for "treason" in the so-called "Terter case". Terter Military Court on January 31, 2019 acquitted 5 of the 8 killed during the investigation. At the same time, their murderers were dropped the murder charge.
Gulaliyev also mentions the attack on the minor daughter of the PFPA Deputy Chairman Fuad Gahramanly and other facts.
Gyulaliyev regrets that the Prosecutor General"s Office not only did not react to the above criminal actions, but also covered them in a number of cases. He urged Garalov to take steps to investigate the facts of torture and murder.
