The court approved the decision on the termination the advocacy of Yalchin Imanov
Baku / 23.02.19 / Turan: On February 22, the Ganja Administrative and Economic Court adopted the final decision on the termination of the legal powers of Yalcin Imanov, Turan was told by Imanov; and he is going to appeal. Since 2007, Imanov has been a member of the Bar Association. However, the Presidium of the Bar Association on November 20, 2017 filed a lawsuit to terminate his advocacy activities. His work as a lawyer was banned even before the court consideration.
Imanov was punished according to the complaint of the Prison Service for publicizing the fact of torture of his client, an activist of the "Muslim unity" movement Abbas Huseynov in Gobustan prison. The Prison Service claimed that Imamov spread false information, and caused damage to the honor and dignity of the prison.
The Ganja Administrative and Economic Court began the trial of Imanov on February 21 of last year. At the preparatory trial, Imanov filed a counterclaim to rescind the decision of the presidium of the Bar Association. However, the claim was not accepted. Imanov appealed this decision first to the Ganja Court of Appeal, and then to the Supreme Court, but his complaints were not satisfied.
On February 14 of this year, the Ganja Administrative and Economic Court resumed consideration of the case. At the trial Imanov said that until now he had not been given the text of the decision of the presidium of the bar association of November 20 and requested to provide a copy of this document.
Imanov also stated that the Presidium of the Bar Association had replaced the conclusion of the Disciplinary Commission (DC) of the Bar Association . Thus, the DC, in its decision of September 9, 2017, concluded that the lawyer did not allow a disciplinary offense. However, this conclusion was later replaced by a different conclusion. Imanov petitioned to request the first conclusion of the DC, to investigate it in court and make a private determination in relation to those who violated the law. He also petitioned to question the members of the DC in court. However, the court did not grant the request of a lawyer.
Earlier, the Institute of Human Rights of the International Bar Association condemned the removal of Imanov from work and called on the authorities to ensure his rights. Imanov was the protector of many famous political prisoners. -03B06--
