Seizure of pickups is a violation of the law and the constitution, lawyers say
Baku/23.09.20/Turan: From September 22, drivers in Azerbaijan began to report the seizure of pickup vehicles from them by the Traffic Police and their delivery to closed parking lots. More often, the police simply record the data of the vehicles and warn about the possible seizure of the vehicles. Some drivers report the seizure of cars for the needs of the Ministry of Defense.
In turn, the Traffic Police Department of the Ministry of Internal Affairs stated that in accordance with the decision of the Cabinet of Ministers of April 4, 2006, during military training, the technical condition of military vehicles is being checked.
“Vehicles of the “pickup” type and other special-purpose vehicles, the technical capabilities of which correspond to the above type, according to the Resolution of the Cabinet of Ministers No. 51 of February 16, 2006, are classified as high-traffic vehicles. For the purpose of technical inspection of operational systems of these vehicles in off-road conditions, clarification of their registration and registration indicators and determination of the territory of their use (city, town, village), these cars stop at stationary posts, their owners are informed about it,” it was reported.
Milli Mejlis deputy Erkin Gadirli believes that the actions of police are wrong. First, the president of the country must declare a mobilization, which can apply to both the citizens themselves and their property. However, the head of state did not do this, so the police break the law.
If cars are seized for accounting, then this can be done much easier: cars are registered when purchased or donated. The owners' names and addresses are known. They can be put on military records (in a single electronic system), Gadirli noted.
Lawyer Alasgar Ahmedoglu also spoke about the absence of military mobilization as a basis for the seizure of pickups. On his Facebook page, he wrote that the state is able to purchase the required amount of transport, and not bother citizens.
Lawyer Samira Agayeva said that the law provides for the seizure of private property for state needs. In this case, the state is obliged to pay compensation for value of the seized property by concluding an act of purchase and sale (Article 29.4 of the Constitution of Azerbaijan). —0—
