Baku/23.01.21/Turan: On May 16, 1918, the construction company “Fedek LLC”, taking advantage of the absence of the owners' house, destroyed the garage and the property of the retired soldier Hamid Efendiyev located in it. He refused to give his four-room apartment with a basement to this company, which intended to destroy the entire building in order to build a high-rise building there. Then the neighboring apartments and the attic of the building were destroyed, and all the ceilings above Efendiev's apartment, located on the first floor. Builders stole 14 art paintings belonging to Efendiyev. He saw one painting in the “Fedek” office and returned it with the efforts of the police.

On 16 (03) 2020, the Baku Court of Appeal considered the complaint of the plaintiff Hamid Efendiyev against the construction company “Fedek” and upheld the decision of the court of first instance, according to which the company was obliged to compensate material damage in the amount of 37.5 thousand manats (the plaintiff requested 80 thousand manats). 10 months have passed, but the company does not comply with the court decision. The information listed in the first paragraph is described in the court statement of Hamid Efendiyev.

To his numerous appeals to the Nasimi court, they say that the decision of the Court of Appeal has been lost, the person responsible for the execution of the decision is unknown, G. Efendiyev informs various instances.

“Fedek” continued to demolish the building despite a separate ruling by the Nasimi District Court of Baku dated November 3, 2018, no.2 (006) - 4635/2018. The court forbade “Fedek” or another organization to destroy the building and create barriers to living in it. Thus, once again, the falsity of statements about the   emergency state of this house is confirmed.

In response to a letter to the Executive Power of Baku sent on September 24, 2020, Efendiyev was informed that his complaint was sent to the head of the  Executive Power of Nasimi region. But this correspondence is also not useful.

On December 15, 2020, unpunished “Fedek” destroyed the roof of the Efendiyevs' apartment. They appealed to the Nasimi court and the Ministry of Emergency Situations, and the answer was that since this case is being considered by the courts, the Ministry of Emergency Situations could not intervene.

The Efendiyevs cannot live in an apartment in a destroyed house at 80 Azadlig Avenue., Apt. 10, due to the obvious danger to life and the absence of a roof. They are renting a hotel room.

On December 25, 2020, the owner of the construction company, Nijat, openly told the tenants that until they gave the apartment to “Fedek”, they would not be able to go there.

Communicating with the Hamidov family, Turan learned that at first, when this company appeared in their yard, there was another person in charge - Yavar Gurbanov, who is currently located in places not so remote due to identified fraud during the construction process.

“It is not clear how this person with a criminal past, who led the construction of the Eifel building and sold the same apartment in it to several people, was able to get from the Executive Power the land plot on which our house is located.

After the arrest of Yavar Gurbanov, the construction site completely stopped, but, unfortunately, they deliberately destroyed our apartment. After Yavar's arrest, Nijat began to appear in his place, but we have never seen any documents about his identity and rights,” said the daughter of the owner of the destroyed apartment, Guler Efendiyeva.

The family presented a document to the editorial office, which shows that the authorized capital of “Fedek” (this is not even MTK) is 100 manats.

The Efendiyev family appeals to the country's first officials, starting from the president, with a reminder of their rights. The family believes that the Articles NN 13, 29, 31, 33 and 43 of the Constitution on property, safe living, the right to housing, the first protocol of the Convention on Human Rights and Fundamental Freedoms are grossly violated.

The editors talked with Nijat Sadigov, the owner of “Fedek”. He said that the Efendiyevs are demanding 690,000 manats for an apartment of 85 square meters The Company is ready to pay them 350,000 manats or buy an apartment with the same area in any district of Baku. However, tenants are demanding a payment for emergency housing that exceeds its market value.

“On January 27 there will be a regular session of the Court of Appeal, which will again consider the Efendiyevs' claim. I will comply with any decision of the state, "Fedek” owner Nijat Sadigov told Turan. –0—
